How to keep your unemployment benefit (paro) after registering as self-employed in Spain in 2026: who qualifies, the 15-day deadline, the 270 days of benefit, what happens with your contributions and if you close, and a worked example with figures.

## The short answer

Yes, in 2026 you can keep your unemployment benefit (paro) after registering as self-employed (autónomo) if you receive the contributory benefit: you keep getting it every month, for up to 270 days, while you work for yourself. You must register with the Seguridad Social and apply to the SEPE within 15 days of starting your activity. The unemployment subsidy cannot be combined.

> [!RESUMEN]
> - Only the contributory benefit can be combined with self-employment; the unemployment subsidy is incompatible with working for yourself.
> - You receive 100% of your benefit, with no contribution deduction, for up to 270 days or whatever you have left if that is less.
> - The deadline to apply is 15 days from the start of the activity and it cannot be extended: if you miss it, you can no longer apply.
> - You are excluded if your last job was self-employed, if you used the compatibility or capitalised your benefit in the previous 24 months, or if you work for your former employer.
> - If you do not combine it, report your registration to the SEPE: if you are registered in the RETA, the benefit is suspended when the activity lasts less than 60 months and you resume it when you close.

This guide reflects the rules in force on 12 October 2026. The SEPE (Servicio Público de Empleo Estatal, Spain's public employment service) pays unemployment benefit, and the RETA (Régimen Especial de Trabajadores Autónomos) is the part of the Seguridad Social, the Spanish social security system, in which you contribute as an autónomo.

## What the law says about paro and self-employment

The general rule is that they are incompatible. [Article 282 of the General Social Security Act](https://www.boe.es/buscar/act.php?id=BOE-A-2015-11724#a282) (LGSS) says that unemployment benefit and the unemployment subsidy are incompatible with self-employed work, even if that work does not require registration with the Seguridad Social.

The exception is in [article 33 of the Self-Employed Workers' Statute](https://www.boe.es/buscar/act.php?id=BOE-A-2007-13409#a33) (Ley 20/2007), in force since 10 October 2015. It lets anyone receiving the **contributory unemployment benefit** keep the monthly payment while working as an autónomo:

- **Duration:** up to 270 days, or the shorter time you have left to receive.
- **Deadline:** you apply to the SEPE within 15 days of the date you start the activity. After that, you cannot apply. The law does not say whether these are calendar or working days; under the general rule in [article 30.2 of Ley 39/2015](https://www.boe.es/buscar/act.php?id=BOE-A-2015-10565#a30) they would count as working days, but do not leave it to the last minute.
- **Effect:** from the date you start the activity, even if you apply a few days later.
- **Early end:** if you take a job as an employee, full time or part time, the compatibility ends.
- **No job-seeking commitment:** while you combine, you do not have the obligations of a registered job seeker.

The SEPE sums it up on its page [He encontrado trabajo como autónomo](https://www.sepe.es/HomeSepe/prestaciones-desempleo/cobrando-prestacion-subsidio-desempleo/trabajo-como-autonomo.html) ("I have found work as a self-employed person"): you receive 100% of the benefit amount, minus the IRPF (income tax) withholding that applies and with no deduction for Seguridad Social contributions.

## Requirements to keep paro after registering as an autónomo

You must meet all of these on the day you start your activity:

| Requirement | What it means in practice | Source |
| --- | --- | --- |
| Receive the contributory benefit | The one you built up paying contributions as an employee, not the subsidy | Ley 20/2007, art. 33.1 |
| Have left your job completely and for good | Reduced hours are not enough | Ley 20/2007, art. 33.1 |
| Register in a Seguridad Social scheme | Normally the RETA; with no registration there is no compatibility | Ley 20/2007, art. 33.1 |
| Your last job was as an employee | If the last thing you did was work as an autónomo, you are excluded | Ley 20/2007, art. 33.2 |
| No compatibility or capitalisation in the previous 24 months | Any use of the compatibility or of the lump-sum payment counts | Ley 20/2007, art. 33.2 |
| Not working as an autónomo for your last employer | Nor for another company in its group | Ley 20/2007, art. 33.2 |
| Apply within 15 days of starting | Non-extendable deadline | SEPE |

The SEPE adds some specific exclusions: you cannot combine if you start working for yourself without registering, if you register as an autónomo to be a partner in a commercial company, or if you join a cooperative or employee-owned company (sociedad laboral) that already existed. It is allowed if you join a **newly created sociedad laboral or worker cooperative** as a partner, under section 5 of article 33.

![If you receive the contributory benefit, your last job was as an employee, you did not use the lump sum or the compatibility in the previous 24 months and you do not work for your former employer, you could combine if you also left your job completely and you register, applying within 15 days. The subsidy cannot be combined.](https://storage.googleapis.com/albert-489117-melso-blog-media/diagrams/en/compatibilizar-paro-y-autonomo/1-decision-a8e700df08.png?w=1600&h=1968&m=1&mw=1080&mh=3261 "Can you keep your paro after registering as self-employed?")

### What if I receive the subsidy?

It cannot be combined with self-employment. Since the reform in Real Decreto-ley 2/2024, the subsidy can be combined as an **employment support supplement** (complemento de apoyo al empleo), but [article 282.3 of the LGSS](https://www.boe.es/buscar/act.php?id=BOE-A-2015-11724#a282) limits it to jobs as an employee, full time or part time. If you receive the subsidy and want to start a business, look at the grants in your autonomous community and the Seguridad Social flat rate.

### What if I am a family-collaborator autónomo?

A family collaborator (autónomo colaborador: a spouse or relative who works in a family member's business) registers in the RETA. Article 33 refers to people who register as self-employed "in any of the Seguridad Social schemes" and does not expressly exclude this case. In principle the same requirements apply, but check with your SEPE office before you register, because the 15-day deadline leaves no room to fix mistakes.

## How much you receive while combining

You receive **the same benefit you had** before registering, in full. There is no special amount for autónomos.

[Article 270 of the LGSS](https://www.boe.es/buscar/act.php?id=BOE-A-2015-11724#a270) sets the amount: 70% of your regulatory base (base reguladora) for the first 180 days of benefit and 60% from day 181. If you are still within the first 180 days when you register, the rate drops to 60% from day 181, just as if you were not self-employed. The amount you receive may not change if you were at the maximum, because the caps in [article 270.3](https://www.boe.es/buscar/act.php?id=BOE-A-2015-11724#a270) apply after the percentage.

The benefit has caps. These come from the SEPE table of [annual amounts](https://www.sepe.es/HomeSepe/prestaciones-desempleo/Cuantias-anuales.html), checked on 12 October 2026. They are the figures for someone who worked full time; if you worked part time in your last 180 days of contributions, the caps are adjusted to your average hours worked, under [article 270.3 of the LGSS](https://www.boe.es/buscar/act.php?id=BOE-A-2015-11724#a270):

| Situation | Minimum a month | Maximum a month |
| --- | --- | --- |
| No dependent children | €560 | €1,225 |
| One dependent child | €749 | €1,400 |
| Two or more dependent children | €749 | €1,575 |

Two differences from ordinary paro:

- **No contribution is deducted.** While you receive paro without working, the SEPE, under [article 273 of the LGSS](https://www.boe.es/buscar/act.php?id=BOE-A-2015-11724#a273), deducts your share of Seguridad Social contributions from your benefit. When you combine, you receive 100%, but you pay your own autónomo contributions.
- **IRPF is withheld.** [Article 17.1.b of the IRPF Act](https://www.boe.es/buscar/act.php?id=BOE-A-2006-20764#a17) counts unemployment benefits as employment income. The SEPE applies the withholding that corresponds to you and, in your income tax return (the renta), you will declare the benefit together with your business profit.

## How to apply for the compatibility, step by step

The order matters, because the 15-day deadline starts running when your activity starts.

1. **Check the requirements.** Look at your SEPE decision: the type of benefit (contributory) and the days you have left. If you have fewer than 270, that is your maximum.
2. **Register with Hacienda.** With Form 036 (modelo 036), the census declaration of the AEAT, Spain's tax agency, before you start invoicing or buy anything for the business.
3. **Register in the RETA.** On Import@ss, with the real start date. That date is the one that counts for the 15 days. If you qualify, apply for the [flat rate](/blog/tarifa-plana-autonomos) (tarifa plana) in the same step.
4. **Apply to the SEPE for the compatibility.** Through the [SEPE online office](https://sede.sepe.gob.es/) or with an appointment at your benefits office. Do it as soon as you are registered, not on day 15.
5. **Get paid and work.** You receive the benefit every month, for up to 270 days, and you invoice like any autónomo.
6. **If you close, ask to resume it.** You have benefit left if you did not use up all the days; you apply within 15 working days of closing. If you apply later, you lose the days that pass until you apply.

The first two steps are covered in detail in the guide to [registering as self-employed](/en/blog/register-as-self-employed-spain).

![Six steps: check the requirements, register with Hacienda on Form 036, register in the RETA, apply to the SEPE for the compatibility within 15 days of starting, receive up to 270 days and, if you close, apply to resume within 15 working days.](https://storage.googleapis.com/albert-489117-melso-blog-media/diagrams/en/compatibilizar-paro-y-autonomo/2-steps-8f89622fed.png?w=1600&h=1122&m=1&mw=1080&mh=2139 "How to keep your paro after registering as an autónomo")

> [!IMPORTANTE]
> The 15 days run from the start date of the activity, the real date you start working for yourself. The SEPE calls them non-extendable: if you apply late, there is no compatibility and the benefit stays suspended while you remain registered. Do not wait until the last day: if you register on a Monday, file the application that same week.

## Example: Marta keeps her paro while starting her photography studio

Marta is a photographer. She worked as an employee until she was dismissed, and the SEPE granted her the contributory benefit. By October 2026 she is past the first 180 days, so she receives 60% of her €1,750 regulatory base: **€1,050 a month**, below the €1,225 maximum. She decides to start as an autónoma on 2 November 2026; on that day, after what she has already received, she has **300 days** of benefit left.

**Step 1. She checks the requirements.** Her last job was as an employee, she has never capitalised or combined, and she will not work for her former employer. She qualifies.

**Step 2. Registrations and application.** She files Form 036 and her RETA registration dated 2 November and applies for the flat rate because it is her first registration. On 3 November she applies to the SEPE for the compatibility, well within the 15 days.

**Step 3. How many days she receives.** When she registers she has 300 days left, but the compatibility maximum is 270, counted from 2 November 2026: if she is paid without interruption, they run to the end of July 2027. The exact payment dates are set by the SEPE decision. At €1,050 every 30 days (€35 a day), that is 270 x 35 = **€9,450** before IRPF withholding.

**Step 4. A typical month.** In her first months she expects her studio to leave her a margin of about €900 a month: income minus business expenses, before her autónomo contribution and IRPF. With the flat rate she pays €80 plus the MEI (the Mecanismo de Equidad Intergeneracional, an intergenerational equity surcharge of 0.9% in 2026 under [Orden PJC/297/2026](https://www.boe.es/buscar/act.php?id=BOE-A-2026-7296#a1-10)). During the flat rate you contribute on the minimum base of band 1 of the general table, €950.98 in 2026, and 0.9% of that base is €8.56. For this example we estimate **€88.56 a month**.

The [Seguridad Social guide](https://portal.seg-social.gob.es/wps/portal/importass/importass/Colectivos/Trabajo+Autonomo/guia) publishes €88.64, eight cents more than that calculation, so the Seguridad Social confirms the actual amount on her first bill; at €88.64, the figures below would be €1,861.36 and €811.36. This typical month is for 2026: in 2027 the MEI rises to 1% under the [forty-third transitional provision of the LGSS](https://www.boe.es/buscar/act.php?id=BOE-A-2015-11724#dt-14). With the same base and the same reduced fee, that would add about €0.95 a month.

![Marta receives €1,050 of benefit, adds €900 of margin from her activity before contributions and IRPF, and pays an estimated €88.56 contribution with the flat rate: she keeps €1,861.44 a month before tax.](https://storage.googleapis.com/albert-489117-melso-blog-media/diagrams/en/compatibilizar-paro-y-autonomo/3-breakdown-2267475140.png?w=1600&h=940&m=1&mw=1080&mh=1707 "Example. Estimated 2026 flat-rate contribution: €80 plus the 0.9% MEI on €950.98 (the Seguridad Social guide publishes €88.64). Before IRPF withholding and the taxes on the activity.")

She keeps **€1,861.44 a month** before tax. Without combining, with the same margin, she would have €811.44 (900 minus 88.56), and the benefit would stay suspended until she closed the activity.

**Step 5. What she keeps in reserve.** When the 270 days end, Marta still has 30 days of benefit. If she closes before reaching 60 months of activity, she can ask to resume those days within 15 working days of closing, by registering again as a job seeker. [Article 33.3](https://www.boe.es/buscar/act.php?id=BOE-A-2007-13409#a33) makes clear that those 60 months count from the date of her registration as an autónoma.

**Step 6. What she cannot do.** For the following 24 months she cannot apply for the lump-sum payment to set up as an autónoma or to contribute capital to a commercial company, under [article 34.1, rule 4, of the Self-Employed Workers' Statute](https://www.boe.es/buscar/act.php?id=BOE-A-2007-13409#a34). If in a year she needs to invest in expensive equipment, she will have to finance it another way.

> [!MELSO]
> The hardest part is lining up Form 036, the RETA registration and the flat rate with the real start date, which is what opens the SEPE deadline. With [self-employed registration through Melso](/en/tramites/alta), a Melso gestor files the registration with Hacienda and the Seguridad Social; plan on filing the SEPE application yourself.

## Combine, capitalise or leave your paro suspended

You have three routes if you receive paro and want to start out. If you combine, for 24 months you cannot capitalise to become self-employed or to join a commercial company, and if you capitalise, you cannot combine: choose before you register.

**Combining** suits you if your business needs little investment and you want a monthly cushion while you find clients. **Capitalising** suits you if you need money up front for equipment or premises: we explain it in the guide to [capitalising your paro](/blog/capitalizar-el-paro). **Leaving it suspended** makes sense if you would rather keep the benefit for later, for example because you are not sure the project will work out. In that case you tell the SEPE that you have started the activity and ask to stop the benefit, as [article 299.1.h of the LGSS](https://www.boe.es/buscar/act.php?id=BOE-A-2015-11724#a299) requires.

![Combining is requested within 15 days of starting and pays every month for up to 270 days. Capitalising is requested before registering and pays what is left up front to invest. Leaving it suspended requires reporting your registration to the SEPE and, if you are registered in the RETA, keeps the benefit if the activity lasts less than 60 months, without using days. The first two block each other for 24 months.](https://storage.googleapis.com/albert-489117-melso-blog-media/diagrams/en/compatibilizar-paro-y-autonomo/4-compare-27f6768718.png?w=1600&h=1490&m=1&mw=1080&mh=2787 "Combine, capitalise or leave your paro suspended")

| | Combine | Capitalise | Leave it suspended |
| --- | --- | --- | --- |
| Legal basis | Ley 20/2007, art. 33 | Ley 20/2007, art. 34 | LGSS, arts. 271 and 272 |
| Deadline | 15 days from starting | Before registering | Report it when you register |
| Autónomo contributions | You pay them | You can ask for payments to cover them | You pay them |
| IRPF | The benefit is taxed | Exempt if you keep the activity 5 years and use it for its purpose | You receive nothing |

The lump-sum exemption is in [article 7.n of the IRPF Act](https://www.boe.es/buscar/act.php?id=BOE-A-2006-20764) and requires you to keep the activity going for five years. The benefit you receive while combining has no exemption: it is taxed like any paro.

## If I become an autónomo, do I lose my paro?

No, if you do things on time. What happens to your benefit depends on how long the activity lasts, under [articles 271 and 272 of the LGSS](https://www.boe.es/buscar/act.php?id=BOE-A-2015-11724#a271) and the SEPE page:

| Your registration during the activity | Duration | What happens to the benefit |
| --- | --- | --- |
| RETA or the seafarers' scheme | Less than 60 months | Suspended; you resume it when you stop |
| RETA or the seafarers' scheme | 60 months or more | It ends |
| Mutual society instead of the RETA | Less than 24 months | Suspended; you resume it when you stop |
| Mutual society instead of the RETA | 24 months or more | It ends |

That is what [article 271.1.d](https://www.boe.es/buscar/act.php?id=BOE-A-2015-11724#a271) says in its current wording. The SEPE page still mentions activities of less than 24 months "even if you have not registered", but always process your registration when it is compulsory: not having it does not make the activity compatible with paro, because [article 282.1](https://www.boe.es/buscar/act.php?id=BOE-A-2015-11724#a282) declares unemployment benefit incompatible with self-employed work even if it does not involve joining the Seguridad Social.

To resume it, you apply within **15 working days** of closing and register again as a job seeker. The entitlement starts the day after you close. If you apply later, under [articles 271.3 and 268.2](https://www.boe.es/buscar/act.php?id=BOE-A-2015-11724#a268) you are paid from the application date and lose as many days as have passed since closing, so a long delay can use up the whole balance you had left.

If, when you close, you are also entitled to the cessation of activity benefit (the autónomo's own unemployment benefit), you can choose between that and reopening your suspended unemployment benefit. If you choose the unemployment benefit, the contributions that generated the cessation benefit cannot be used for a later entitlement, under [article 33.4 of the Self-Employed Workers' Statute](https://www.boe.es/buscar/act.php?id=BOE-A-2007-13409#a33).

> [!CONSEJO]
> Before you decide, ask the SEPE online office for the details of your benefit: days used, days left and daily amount. With those three figures you know whether combining, capitalising or keeping the benefit for later suits you best.

## What happens with your autónomo contributions and Hacienda

Combining does not change your obligations as an autónomo. From day one:

- **You pay the RETA contribution.** With the [flat rate](/blog/tarifa-plana-autonomos), €80 a month plus the MEI for 12 months. You qualify if it is your first registration or you have not been registered in the previous two years (three if you already had it), and it does not apply to relatives of the autónomo up to the second degree, under [article 38 ter of the Self-Employed Workers' Statute](https://www.boe.es/buscar/act.php?id=BOE-A-2007-13409#a3-5). The [fifth transitional provision of Real Decreto-ley 13/2022](https://www.boe.es/buscar/act.php?id=BOE-A-2022-12482#dt-5) set the €80 for 2023 to 2025 and leaves the 2026 figure to the Budget Act. There is no 2026 budget: the 2023 one remains extended, as [Orden ISM/727/2026](https://www.boe.es/eli/es/o/2026/07/13/ism727/dof/spa/pdf) notes, and the Seguridad Social keeps applying €80, according to its [guide](https://portal.seg-social.gob.es/wps/portal/importass/importass/Colectivos/Trabajo+Autonomo/guia). If you do not qualify, your contribution depends on your net income: see [autónomo contributions in 2026](/en/blog/autonomo-social-security-contributions-spain-2026).
- **You invoice and file your returns.** VAT (IVA) and IRPF payments on account every quarter, depending on your activity, like any autónomo.
- **You declare everything in your income tax return.** The benefit as employment income and your business profit as income from economic activities.

## Common mistakes when combining paro and self-employment

- **Applying late.** The 15-day deadline cannot be extended. Once it has passed you lose the compatibility.
- **Mixing up the subsidy and the benefit.** If you receive the subsidy, you cannot combine it with self-employment.
- **Working without registering.** With no registration in a Seguridad Social scheme there is no compatibility, and receiving paro while working for yourself is incompatible even if the activity does not require registration.
- **Putting a date that is not the real one on your registration.** The RETA start date opens the 15-day deadline: if you put a date before your real start, the deadline starts running earlier and you may miss it.
- **Invoicing your former employer as an autónomo.** If you sign with your last employer or its group, you are excluded.
- **Having capitalised or combined less than 24 months ago.** If you received the lump sum, you cannot combine; if you combined, you cannot capitalise to become self-employed or to join a commercial company.
- **Forgetting that you use up days.** The 270 days come off your benefit. If you close, you can only resume what you have left.
- **Not reporting your registration or not asking to resume.** If you do not combine, report your registration to the SEPE. When you close you have 15 working days to resume; after that you lose days.

## How Melso helps

Melso is your AI tax agent, with human professionals behind it: if you decide to combine, it collects what your [self-employed registration](/en/tramites/alta) needs and a Melso gestor files it with Hacienda and the Seguridad Social. After that, on WhatsApp, it organises your invoices and expenses, lets you check the tax calendar, and its professionals prepare and review the included returns for your activity and tax profile. See the [plans and prices](/en/pricing), [get started at melso.ai](https://melso.ai) or tap **Message us on WhatsApp**.

The SEPE compatibility application is not a Hacienda or Seguridad Social procedure: plan on filing it yourself, or ask Melso before signing up whether it can prepare it for you.

## Frequently asked questions

### Can I receive unemployment benefit and be self-employed at the same time?

Yes, if you receive the contributory unemployment benefit. Article 33 of the Self-Employed Workers' Statute lets you keep receiving it every month while you work as an autónomo, for up to 270 days or whatever you have left if that is less. You must register with the Seguridad Social and apply to the SEPE for the compatibility within 15 days of starting your activity.

### What happens to my unemployment benefit if I become self-employed?

If you do not apply for the compatibility, you must tell the SEPE that you have started your activity and ask to stop the benefit, as article 299 of the General Social Security Act requires. If you are registered in the RETA and the activity lasts less than 60 months, the benefit is suspended and you can resume it by applying within 15 working days of closing. At 60 months or more, it ends for good.

### Do I lose my paro if I become an autónomo?

Not automatically. You have three routes: combine it with your activity and keep receiving it for up to 270 days, capitalise it and take it up front to invest, or report your registration to the SEPE and leave the benefit suspended. If you are registered in the RETA, it ends if the activity lasts 60 months or more. If you apply late to resume it when you close, you lose the days that pass until you apply and you may use up the balance.

### Can I combine the unemployment subsidy with being self-employed?

No. The article 33 compatibility only covers the contributory benefit, the one you build up by paying contributions as an employee. Article 282 of the General Social Security Act declares the subsidy incompatible with self-employed work. The employment support supplement, which does let you keep part of the subsidy while you work, only exists for jobs as an employee.

### What is the deadline to apply for the compatibility between paro and autónomo registration?

Fifteen days from the date you start your self-employed activity, under article 33 of the Self-Employed Workers' Statute. The SEPE describes it as non-extendable: once it has passed, you can no longer apply. The compatibility takes effect from the start of the activity, so you do not lose days by applying within the deadline. The sensible thing is to file it in the first few days.

### How much unemployment benefit can an autónomo receive?

The same as you received before registering: 70% of your regulatory base for the first 180 days of benefit and 60% after that. According to the SEPE table, the maximum for a full-time job is €1,225 a month with no children, €1,400 with one child and €1,575 with two or more; if you worked part time before, it is adjusted. While you combine it with your activity you receive 100% of that amount, with no contribution deduction and only the IRPF (income tax) withholding.

### Can I combine paro with being a family-collaborator autónomo?

Article 33 refers to holders of the contributory benefit who register as self-employed in a Seguridad Social scheme, and a family collaborator (autónomo colaborador) registers in the RETA. The law does not expressly exclude that case, so in principle the same requirements apply. The SEPE decides each individual case.

### Can I get the flat rate if I combine paro with self-employment?

Yes, neither rules out the other. You qualify if it is your first RETA registration or you have not been registered for two years (three if you already had it), and relatives of the autónomo up to the second degree are excluded. In 2026 the Seguridad Social applies a fee of €80 a month plus the MEI for 12 months, because there is no 2026 Budget Act setting another figure. At 0.9% on the minimum base of €950.98 it comes to €88.56; its guide publishes €88.64, so check the amount on your bill. You apply for it in the same step as your registration.

### Can I capitalise my paro after combining it with self-employment?

Not to become self-employed during the following 24 months. Article 34.1, rule 4, of the Self-Employed Workers' Statute denies the lump-sum payment to set up as self-employed or to contribute capital to a commercial company to anyone who has used the compatibility in the previous 24 months. It also works the other way: if you received the lump sum in the last 24 months, you cannot combine.

### Is the paro I receive while self-employed taxed?

Yes. Article 17.1.b of the IRPF Act treats unemployment benefits as employment income, and the SEPE applies the withholding that corresponds. In your income tax return you will add the benefit as employment income and your business profit as income from economic activities. The IRPF exemption only exists for the lump-sum payment, not for the monthly benefit.
