What filing a Spanish tax return late costs.
Missed a deadline? If the tax office (Hacienda) has not asked you for the return yet, filing it soon keeps the cost down. Enter the amount and the dates to see the surcharge, the interest or the fine, and when it goes up.
What filing late costs
How it is calculated.
Full months late.
Months run date to date from the day after the deadline: for a 20 July deadline, the first full month ends on 20 August.
The surcharge.
If there is something to pay, 1% of it plus 1% for each full month late, and no fine. After 12 months, a flat 15% (article 27.2 of Spain’s General Tax Law).
The 25% reduction.
Pay the return when you file it, and the surcharge when Hacienda sends it, and the surcharge is 25% lower (article 27.5).
Late-payment interest.
Only after 12 months: from the next day until you file, at 4.0625% a year in 2026, each year counted by its own days.
If there is nothing to pay.
There is a fixed fine of €200, halved if you file before Hacienda asks, and 40% lower again if you pay it on time without appealing (articles 198 and 188.3).

What people ask us most.
If you file before Hacienda asks, 1% of the amount plus 1% for each full month late, up to 12%. After 12 months, 15% plus late-payment interest. Paying when you file takes 25% off the surcharge.
Yes, a fixed fine of €200, which drops to €100 if you file on your own, and to €60 if you also pay it on time and do not appeal.
The fine is €20 for each person or business the return should list, at least €300 and at most €20,000. Filed on your own, it is half: €10 each, at least €150.
There is no surcharge any more: if money was owed, the penalty starts at 50% of the unpaid amount, plus interest. That is why it pays to file before a request (requerimiento) arrives.
You lose the 25% reduction and, unless you ask to pay in instalments (aplazamiento) when you file, the debt goes to enforced collection with a further surcharge from 5%.
